Abstract

The phenomenon of forced migration and the problems that this phenomenon created affects entire states in a kind of way. This phenomenon is addressed within the norms of humanity of today’s civilization but there are big troubles about the issue of asylum-seekers in Europea, the place of human rights. There is more need to protect these people who are in difficult situation and exposed to the hardships of the sea. Yet the asylum-seekers at sea have major problems in the protection area of the the European Convention on Human Rights. The relationship between asylum-seekers at sea and the European Convention on Human Rights will be examined in this study. In this regard, the issues of the principle of non-refoulement and the jurisdiction within the context of the European Convention on Human Rights, by mentioning the importance of Hirsi case, will be analysed.
