CLOSURE OF THE MILITARY COURTS WITH CONSTITUTIONAL AMENDMENT NUMBERED THE LAW NO. 6771 AND MILITARY PROSECUTION OF MILITARY PERSONNEL FOR MILITARY CRIMES 6771 SAYILI ANAYASA DEĞİŞİKLİĞİ İLE ASKERİ MAHKEMELERİN KAPATILMASI VE ASKER KİŞİLERİN ASKERİ SUÇLARI BAKIMINDAN YARGILANMASI
With the Law No. 6771 on amendments to the Constitution, military courts removed. The Draft Code containing amendments to the Law No. 1632 Military Criminal Code on military crimes committed by military personnel was prepared and sent to The Grand National Assembly of Turkey on June 12, 2017. The Draft is still not legalized. Despite the fact that the military courts have been closed, the implementation of Law No. 353 leads to problems for the crimes committed by soldiers due to their services and duties. This article will examine the Draft’s regulations envisaged for the criminal proceedings against military offenses of the military personnel, problems during the transition period will be identified and a solution proposal will be presented.
