Abstract

Türkiye’de memurların özlük haklarına ilişkin her türlü düzenlemenin “kanunla” yapılması gerektiği kurala bağlanmıştır. Bu anlamda devlet tek taraflı olarak düzenleme yapmakta ve 1982 Anayasasına göre memurların özlük hakları kanunla düzenlenmektedir. 2010 yılında yapılan Anayasa değişikliği ile birlikte mali ve sosyal haklar konusunda toplu sözleşme ile de düzenleme yapılmasına olanak tanınmıştır. Ancak toplu sözleşme sürecinde, kamu görevlilerini temsil eden yetkili sendika ile hükümet temsilcileri yalnızca mali ve sosyal haklarda değil tüm kamu çalışanlarını ilgilendiren birçok konuda değişiklik yapmaktadırlar. 2012 yılından itibaren 3 adet toplu sözleşme imzalanmıştır. Bu çalışmada toplu sözleşmelerin içeriği ve hukuki niteliği analiz edilerek yapılan düzenlemelerin kamu personel rejimine etkisi tartışmaya açılacaktır.

Abstract

According to the 1982 Constitution, civil servants' personal rights were regulated by law. In this sense, the state is regulating unilaterally and according the 1982 Constitution, the personal rights of civil servants are regulated by law. With the amendment made in 2010, it was also possible to make arrangements by collective agreement on financial and social rights. But during the collective bargaining process, the authorized trade union representing the public officials and government representatives sat at the desk and made amendments to a number of issues involving all public employees. Since 2012, three collective agreements have been signed. In this study, the content of the collective contracts will be analyzed and the legal nature of the contracts and the effect of the regulations on the public personnel regime will be discussed in detail.
