Abstract

Suç ekonomisi günümüzde sıkça tartışılan çözümler üretilmesi gereken önemli bir kavram olarak karşımıza çıkmaktadır. Sadece gelişmekte olan ülkeler değil, gelişmiş ülkelerde de bu durum önemli bir sorundur. Ekonomik suçlar, en geniş anlamıyla şahısların ya da suç örgütlerinin haksız ekonomik çıkar sağlamak amacıyla yasa dışı yöntemlerle gerçekleştirmiş oldukları suç faaliyetlerdir. Ekonomik suçlar içerisinde Nitelikli dolandırıcılık (yatırım, sigorta, çek ve benzeri gibi dolandırıcılık suçları), Tefecilik, Şike ve teşvik primi, Hileli iflâs, Fiyatları etkileme, Kamuya gerekli şeylerin yokluğuna neden olma, Mal veya hizmet satımından kaçınma, Manipülasyon ayrıca Ekonomik, Ticari ve Sınaî hayatı ilgilendiren özel kanunlardaki adli cezayı gerektiren suçlar yer alır.Bu suçlardan dolayı uluslararası ekonomik ve finansal ilişkilerin daha önceki dönemlerle mukayese edilemeyecek derecede artması ve teknolojinin sağladığı imkânlar nedeniyle ülke sınırlarını aşan tekniklerin kullanılması, ülkeleri daha yoğun bir şekilde işbirliği yapmaya yöneltmiştir. Bu bağlamda en fazla işbirliği gereken suçların başında, suçluların yeni işleyecekleri suçlara sermaye oluşturmasını sağlayan mali suçlar gelmektedir. Mali suçlar, küreselleşme ve gelişen teknoloji ile birlikte mücadelesi her geçen gün önem kazanan suç türlerindendir. Bu suçlar tüm dünyada olduğu gibi ülkemizde de ekonomik, siyasi, sosyal ve ahlaki yapıyı olumsuz yönde etkilemektedir. Ekonomik, ticari ve sınai hayatı ilgilendiren suç türleri, bir bütün olarak ekonomik dengeleri etkileyebilecek, büyük kitlelerin mağdur olmasına yol açabilecek suç türleridir. Ekonomik suçlar kayıt dışı ekonomiyi arttırarak devletin vergi kaybına neden olur. Özellikle ticari ve sınaî hayatımızı yakından ilgilendiren “ekonomik güvenliğimizi” tehdit eder. Ayrıca karşılıklı güven esasına dayalı olarak gerçekleşen piyasa faaliyetlerinin bozulmasına yol açarak toplumda var olan huzur ve güven ortamını bozabilmektedir. Bu çalışmada öncelikle İçişleri Bakanlığı orijinal arşiv belgeleri ve temel kaynaklar ışığında 2012-2017 yılında Organize Suçların Türkiye Ekonomisine Etkisi konusu incelenmeye çalışılacaktır.

Abstract

Crime economics is an important concept that needs to be produced. This is an important problem not only in developing countries but also in developed countries. Economic offenses, in the broadest sense, are criminal activities carried out by individuals or criminal organizations by illegal methods in order to provide unjust economic benefits. Qualified fraud in economic crimes (fraud crimes such as investment, insurance, checks and the like), usury, match-fixing and incentive bonus, fraudulent bankruptcy, affecting prices, causing the absence of necessary goods, avoiding the sale of goods or services, Criminal offenses in the special laws concerning industrial life shall take place. Due to these crimes, international economic and financial relations cannot be compared with previous periods and the use of techniques exceeding the borders of the country due to the opportunities provided by the technology has led the countries to cooperate more intensively. In this context, at the beginning of the crimes that need to be cooperated the most, financial crimes that enable the criminals to create capital for the new crimes will come. Financial crime, globalization and developing technology are among the types of crime that are gaining importance every day. These crimes affect the economic, political, social and moral structure negatively in our country as well as all over the world. The types of crime related to economic, commercial and industrial life are the types of crimes that can affect the economic balances as a whole and cause the masses to become victims. Economic crimes increase the informal economy and cause the state to lose tax. It threatens our ızı economic security “which is closely related to our commercial and industrial life. In addition, it can disturb the environment of peace and confidence in the society by causing deterioration of market activities based on mutual trust. This study, the first original archival documents and basic Interior Ministry sources said Turkey Effect of Organized Crime economy in 2012-2017 will be examined in the light.
