Abstract

Most of the international trade is carried out on the seas. Sea transportation is less cost-effective than other transportation methods, and has a higher carrying capacity at one time. Nowadays, maritime banditry is one of the factors that threaten sea transportation and naturally the global economy. Maritime banditry activities are carried out in the world by the well-organized sensational attacks on the routes where maritime trade is intensely carried out, especially in Southeast Asia, the Gulf of Aden and the coast of Somalia with the driving force of advanced technology. As a result of these attacks against commercial ships and humanitarian aid ships passing through the mentioned routes and the incidents such as taking hostages and ransom demands, the international community has become anxious and oriented towards taking measures in this regard. In the study, first of all, individuals will be considered as a subject of international law and then the criminal responsibility of individuals will be explained in the context of the regulations on international maritime banditry.
