Abstract

Kozan Mebusu Ali Saip Ursavaş (1887-1939) 3 Aralık 1924 tarihinde basın kanununa birtakım maddelerin eklenmesi yönünde Meclise bir teklif vermiş ve bu teklif dönemin basınında büyük bir tepkiyle karşılanmıştır. Teklife göre, gazete imtiyazı alabilmek için gazete imtiyaz sahiplerinin, sorumlu müdürlerinin ve muhabirlerinin yüksekokul mezunu olması, gazete çıkarabilmek için İstanbul ilinde beş bin lira, İstanbul dışında ise iki bin beş yüz lira depozito verilmesi gerekmektedir. Gazetesi kapatılan imtiyaz sahibinin depozitosuna devletçe el konulacak ve bir daha gazete imtiyazı alamayacaktır. Ayrıca basın yoluyla işlenen suçlar, cinayet suçuyla eş değer kabul edilecek ve zamanaşımı açısından ilgili genel hükümlere tabi olacaktır. Teklif, dönemin şartları düşünüldüğünde gazetecilik mesleğini adeta imkânsız hale getirmektedir. Nitekim İstanbul matbuatı da meseleyi bu yönde değerlendirerek bu teklifin esasen hükümetin İstanbul matbuatının sesini kısma eylemi olarak yorumlamıştır. Ankara ve İstanbul matbuatında var olan sürtüşme ve kalem kavgalarının bir tezahürü olarak da değerlendirilen bu teklife, kamuoyunun şiddetli tepki göstermesi, teklifin yasalaşmasını önlemiş ve konu sadece kanun teklifi aşamasında kalmıştır. Bu makalede erken cumhuriyet dönemi basın iktidar ilişkileri, matbuat kanununa bazı maddeler eklenmesine dair 1924 tarihli kanun teklifi örneğiyle ele alınmış ve Tevhid-i Efkâr gazetesinde yayınlanan karikatürler üzerinden tanımlayıcı / betimleyici araştırma ile basının kanun teklifine bakışına yönelik bir durum tespiti yapılmaya çalışılmıştır.

Abstract

Kozan Deputy Ali Saip Ursavaş (1887-1939) submitted a proposal to the Parliament on 3 December 1924 to add some articles to the press law and this proposal was met with a great reaction in the press of the period. According to the proposal, in order to obtain a newspaper license holder, newspaper license holder owners, responsible managers and reporters must be college graduates, in order to publish a newspaper, a deposit of five thousand liras is required in Istanbul and two thousand five hundred liras is required outside Istanbul. The deposit of the license holder whose newspaper is closed will be confiscated by the state and he will not be able to receive a newspaper concession again. In addition, crimes committed through the press will be equivalent to the crime of murder and will be subject to the relevant general provisions in terms of the statute of limitations. Considering the conditions of the period, the proposal makes the profession of journalism impossible. As a matter of fact, the Istanbul press evaluated the issue in this way and interpreted this proposal as the government's action to silence the voice of the Istanbul press. The strong public reaction to this proposal, which was also considered a manifestation of the friction and pen fights existing in the Ankara and Istanbul press, prevented the proposal from becoming law and the issue remained only at the bill stage. This study, which aims to make a modest contribution to the history of the press, is essentially a summary of the press-government relations. This article examines the relationship between the press and power in the early Republican period, using the 1924 bill proposing additions to the press law as an example. Through descriptive research based on cartoons published in the Tevhid-i Efkâr newspaper, it attempts to assess the press's perspective on this bill.
