MERĞÎNÂNÎ’NİN EL-HİDÂYE’SİNDE İHRAM KONUSUNDA İMAM MÂLİK’E NİSBET EDİLEN GÖRÜŞLERİN TESPİT VE TAHKÎKÎ

Abstract
Mukayeseli fıkıh eserlerinin bazılarında çeşitli sebeplerle hatalı bilgi ve nakillere rastlanabilmektedir. Bunlardan birirsi de Burhaneddin el-Merğînânî’nin (ö. 593/1197) el-Hidâye fî şerhi Bidâyeti’l-Mubtedî adlı eseridir. Adı geçen eserde İmam Mâlik’e nispet edilen görüşler de bulunmaktadır. Onlardan bir kısmı hac ibadetiyle ve daha çok ihram konusuyla ilgilidir. Bunların önemli bir kısmının adı geçen müctehide nispet ve değerlendirilmesinde hata yoktur. Ancak bazılarında mezhebin muteber kaynaklarındaki bilgi ile çelişen görüşler bulunmaktadır. Bu sebeple onların tespit ve tahkîkî önem arz etmektedir. Bu makale ile adı geçen eserin hac bölümünde İmam Mâlik’e nispet edilen ihram konusu ile ilgili görüşlerin muteber Mâliki kaynaklarla karşılaştırılması suretiyle tespiti ve tahkîkî hedeflenmiştir.

Abstract
It may occur that there are errored information and false conveying in some various comparative works on Islamic law. One of those works is written by Burhaneddin Al-Merginani, and it’s named “Al Hidayah fi sherhi Bidaati’l Mubtedi”. In this mentioned work, there are also remarks that are correlated to Imam Malik. Some of these remarks are about hajj and mostly about ihram. There exists no errors in a significiant amount among these correlations and evaluations directed to the interpreter. However, some of them contains remarks that contradict with the communion’s respected sources. For this reason, it is important to determine and investigate these correlations and evaluations. With this article, it is aimed to determine and investigate these remarks correlated to Imam Malik in the work’s “Hajj” chapter by the means of comparing them to the Maliki communion’s respectful sources.
